Rule 33.09 Misdemeanors or Felonies - Failure of Court to Set Conditions of Release, or Setting of Inadequate or Excessive Conditions of Release - Application to Higher Court

If someone is charged with a crime and they think the judge made a mistake about their release from jail, this rule explains what they can do about it. This applies whether the judge kept someone locked up who should have been released, let someone go free who should have stayed in custody, or set conditions for release that were either too strict or too lenient.

Both the defendant and the state (the prosecutor) can challenge these decisions. If either side believes the judge got it wrong, they can ask a higher court to step in and fix the problem. This is done through a special process called a writ, which is filed under Rule 84.24.
