Rule 33.11 Misdemeanors or Felonies - Bonds - Where Filed - Certification by Sheriff or Peace Officer - Cash Bonds

When someone posts bond in a criminal case, the paperwork has to end up in the right place. This rule says the bond must be filed with the clerk of the court where the defendant has to show up for their case.

If a sheriff or another peace officer is the one who takes the bond, they can't just hold onto it. They have to certify it (basically sign off that it's official) and then send it to the clerk of the proper court.

The rule also covers cash bonds or other approved forms of payment, like certain securities. If someone pays cash or hands over securities to secure their release, that money or property has to go to the clerk of the court, not to the officer who collected it. The clerk then deposits it into the court's official registry, so there's a clear record of who paid what and where it's being held.

This rule basically makes sure bond money and paperwork are properly tracked and handled by the court, not left with individual officers. That protects the defendant's payment and keeps everything accountable.
