Rule 37.56 Continuances

Both sides in a case have the right to a speedy trial. This means the court is expected to move the case forward without unnecessary delays.

That said, a judge can still push back the trial date if there's a good reason. This is called a continuance. Either the prosecution or the defense can ask for one, but they need to show the judge a real reason why more time is needed. Simply wanting more time isn't enough on its own; there has to be a valid reason behind the request.

In practice, this rule balances two needs. It keeps cases moving so people aren't stuck waiting for months or years without resolution. At the same time, it allows some flexibility if something comes up, like needing more time to gather evidence or find a witness, that makes a delay reasonable and fair.
