Rule 37.72 Trial De Novo - Stay of Execution

When someone asks for a new trial (called a trial de novo) after losing in municipal court, that request automatically puts the original judgment on hold. This means the court cannot enforce the penalty, fine, or other punishment while the request for a new trial is pending.

However, this hold does not last forever. If the person who asked for the new trial changes their mind and withdraws the request, the case goes back to municipal court so the original judgment can be enforced. The same thing happens if the person simply drops the matter and the court decides, before the new trial starts, that they have given up on it. In both situations, the case returns to municipal court and the original penalty can be carried out.

This rule exists to protect people while they exercise their right to ask for a new trial, but it also makes sure cases do not stay stuck in limbo if someone stops pursuing that new trial.
