Rule 48 Number of Jurors

Here's a plain English summary of this rule:

In a civil trial, the jury normally has eight people on it. This is the standard number the court will use unless something different is agreed to.

The people involved in the case can agree to use a different number of jurors instead of eight. Both sides need to sign off on this change through a stipulation, which is just a formal agreement between the parties.

No matter what the parties agree to, the jury can never have fewer than four members. This is the smallest number allowed, even if everyone agrees to a smaller jury. So while there's some flexibility in jury size, four people is the absolute minimum needed to hear a civil case.
