Rule 4:43-4 Plaintiffs, Counterclaimants, Cross-Claimants

When someone files a lawsuit, they are not always the original plaintiff. Sometimes a defendant files their own claims against other parties in the same case.

This rule says that the default judgment process works the same way for everyone who has filed a claim, no matter what their role is in the case. It does not matter if you started the lawsuit, filed a counterclaim against the person who sued you, or filed a cross-claim against another defendant. If the other side fails to respond or show up, you can seek a default judgment using the same steps.
