Rule 4:46-4 Leave to Proceed Upon Terms

When a court gives you permission to move forward with a summary judgment motion, it can attach conditions to that permission. The judge decides what those conditions are based on what seems fair.

For example, the court might require you to post a security deposit, follow a specific timeline, or proceed in a certain way. The judge has wide flexibility to set whatever terms make sense for the situation.
