Rule 4:51-5 Effect of Prior Writ of Attachment

If your property has already been seized through an attachment order in a case, the court cannot also issue a writ to physically detain you or prevent you from leaving the state in that same case. The law treats these as separate tools, and using both against you at the same time in the same lawsuit is not allowed.

There is one exception to this protection. Under Rule 4:60-4, a court can order both your property seized and your arrest if specific conditions are met. So while the general rule protects you from double action, that protection is not absolute.
