Rule 4:62-3 Tender; Deposit in Court

When the State of New Jersey files a lawsuit to settle ownership of waterfront or underwater land, the Attorney General does not have to pay any money upfront. Most parties in a legal dispute must offer payment or deposit money with the court before or when they file their case, but the State is excused from this requirement.

This rule only applies to the government, not to private individuals or businesses. If you are a private party in a dispute over waterfront property, normal court rules about payments and deposits would still apply to you.
