Rule 4:69-2 Motion for Summary Judgment

When someone files a lawsuit asking a government official or agency to carry out a basic, required duty, they do not have to wait long to push the case forward. They can ask the court for a quick decision right away after filing their complaint.

To do this, the person must file a motion for summary judgment. Along with that motion, they need to include an affidavit (a written statement of facts signed under oath) and written legal arguments called briefs. These documents help the court understand why the official should be ordered to act without needing a full trial.
