Rule 4:73-5 Fees and Costs

When a property owner's land is being taken by the government (eminent domain), a court can order the plaintiff, usually the government agency taking the property, to pay certain costs related to the case.

These costs can include the fees and expenses of the commissioners, who are the people appointed to help determine how much the property is worth. Any party in the case, including the commissioners themselves, can ask the court to approve these payments.

The court gets to decide whether to grant this request and how much to allow. The party asking must show the court that the fees and costs are reasonable before the court will approve them.
