Rule 4:88-3 Notice as to Apportionment of Commissions

If there are multiple people managing an estate or trust together, they are called cofiduciaries. When one of them asks the court to divide up the fees (called commissions) among the group, the court will not act on that request right away.

Before the court can split up those fees, anyone asking for the split must give at least five days' notice to the other cofiduciaries who are not present at the hearing. The person making the request must also show proof to the court that this notice was given.
