Rule 3:28-2 Timing of Application

If you want to apply for pretrial intervention (PTI), you need to do it as soon as possible. PTI is a program that lets some people avoid a criminal trial by completing certain requirements instead. You should apply before you are formally charged (indicted) if you can, but you must apply no later than your Initial Case Disposition Conference.

If you miss that deadline, you can still apply if you have a good reason for the delay or if the prosecutor agrees to let you apply late. Missing the deadline without one of these exceptions will likely mean you lose your chance to enter the program.
