Rule 3:5-1 Authority to Issue

A search warrant is a court order that allows police to search a place and take certain property. Only a judge can issue one, and that judge must work in the same area where the search will happen.

If police want to search a home or business, they cannot just do it on their own. They need to go to the right judge, meaning one who has authority in that town or city, to get permission first.
