Rule 5:24-3 Manner of Disposition

If a judge decides the evidence proves the charge against a young person, the judge has several options for what happens next. The judge is not limited to one type of punishment or outcome.

The judge can choose either a custodial disposition, meaning the young person is placed somewhere outside their home, or a non-custodial disposition, meaning the young person stays in the community. The judge can also attach conditions to either option, such as requiring counseling, community service, or check-ins with a probation officer.

The specific rules about what dispositions are available and what conditions can be set come from New Jersey state law, specifically sections 2A:4A-43 and 2A:4A-44.
