Rule 1:12-2 Disqualification on Party's Motion

If you are involved in a court case, you have the right to ask a judge to step down from your case. You do this by filing a motion, which is a formal written request, before the trial or argument begins. You must explain in that request why you think the judge should not handle your case.

This rule gives all parties in a case the same right to make this request. The motion must be made before the case goes to trial, not after. Waiting too long may mean losing your chance to raise the issue.
