Rule 7:8-6 Transfer to the Chancery Division, Family Part

If you have a case in a municipal court and it involves family-related matters, it can be moved to a different, higher court. That court is called the Superior Court, Chancery Division, Family Part, which handles family law cases.

The transfer follows specific rules already in place for how family cases are handled in New Jersey courts. If your municipal court case fits those guidelines, a judge can send it to the family court instead.
