New Mexico Court Rules (2026)
We publish 26 sets of the New Mexico Rules Annotated, totaling 1303 rules. New Mexico pairs a numbered set to each court and subject, so the same motion carries a different rule number in the district, magistrate, metropolitan and municipal courts — cite the right set. Coverage includes civil and criminal procedure for every court level, evidence, appellate procedure, the Children's Court rules, and the rules governing professional conduct, judicial conduct, bar admission and discipline. The Uniform Jury Instructions and the forms sets are not included, and neither are the Rules of Legal Specialization, which the Supreme Court withdrew in their entirety. Each rule includes the full text, a plain-English summary, committee notes, amendment history, and cross-references to related rules.

Rules of Civil Procedure for the District Courts
The Rules of Civil Procedure for the District Courts, Set 1 of the New Mexico Rules Annotated. They track the pre-restyle Federal Rules with New Mexico numbering, so summary judgment is Rule 1-056 and an answer is due 30 days after service under Rule 1-012(A). Coverage runs from commencement and service through pleadings, parties, discovery, trial and judgment, and includes the administrative-appeal routes at Rules 1-074 and 1-075.

BrowseRules of Criminal Procedure for the District Courts
The Rules of Criminal Procedure for the District Courts, Set 5. Felonies proceed by grand jury indictment or by information after a preliminary examination, both live options under the state constitution. Rules 5-501 and 5-502 govern disclosure by the state and by the defendant, and Rule 5-802 is the primary means of postconviction relief. New Mexico withdrew its fixed six-month trial rule for district courts in 2010, so speedy-trial analysis here is constitutional.

BrowseRules of Evidence
The Rules of Evidence, Set 11, modeled on the Federal Rules and restyled in 2012 to follow the federal restyling. Cited by rule number — Rule 11-401 NMRA. New Mexico follows Daubert through State v. Alberico, decided two months after Daubert itself, which grounded admissibility in Rule 11-702's validity and reliability inquiry rather than general acceptance.

BrowseRules of Appellate Procedure
The Rules of Appellate Procedure, Set 12. Most appeals go to the Court of Appeals; the Supreme Court takes direct appeals where a sentence of death or life imprisonment was imposed, appeals from the Public Regulation Commission, and appeals from the granting of habeas corpus. Since 2023, on-record Metropolitan Court appeals go directly to the Court of Appeals rather than through district court.
