§ 208.31 Restoration after jury disagreement, mistrial or order for new trial

When a jury can't agree on a verdict, or when a mistrial happens, or when a judge or appeals court orders a new trial, the case doesn't just disappear. It goes back on the court's active schedule so it can be tried again.

To make this happen, someone needs to file a notice with the court clerk. This notice tells the court that the case is ready to move forward again. Once it's filed, the case gets placed back on what's called the "ready calendar," which is the list of cases that are prepared to go to trial.

This rule basically covers what happens next after a trial doesn't produce a final result. Instead of the case being stuck in limbo, filing this simple notice restarts the process so both sides can get back in front of a judge or jury.
