§ 208.36 Infants' and incapacitated persons' claims and proceedings

If a lawsuit involves a child under 18 or someone who has been legally declared incapacitated, the settlement of that case has to follow specific extra rules. These rules exist to protect people who may not be able to fully look out for their own interests in legal matters.

The settlement must follow certain sections of state law (CPLR 1207 and 1208), plus a court administrative rule (22 NYCRR 202.67). If the case involves a child specifically, the settlement also has to follow Judiciary Law section 474, which deals with how lawyers get paid in these situations.

In practical terms, this means you can't just settle a case involving a child or incapacitated person the same way you would with any other adult. A judge typically needs to review and approve the settlement to make sure it's fair and that the person's money or interests are properly protected, often through a court-appointed guardian or representative.
