§ 210.31 Restoration after jury disagreement, mistrial or order for new trial

If a jury can't agree on a verdict, or if a judge declares a mistrial, or if a new trial gets ordered, the case doesn't just disappear. It goes back on the calendar to be tried again.

There's one extra step when an appeals court is the one that orders the new trial. In that situation, someone has to file a formal notice with the court clerk to get the case rescheduled. This makes sure the case moves forward instead of sitting idle after the appeal decision comes down.
