§ 1334 Motion papers

When a government agency wants a preliminary injunction, it cannot just ask for one verbally. It must back up its request with written proof.

The agency needs to file an affidavit, which is a written statement signed under oath. Along with that, it can submit other written evidence to support its case. The written proof must show two things: that there is a real legal claim, and that there are valid reasons why the court should grant the injunction.
