§ 245.90 Federal and state constitutional obligations

The prosecution must follow the rules in this article, but those rules are not the only thing they have to follow. The Constitution, both federal and New York State, also sets requirements for what the prosecution must share with the defense.

If the Constitution requires the prosecution to hand over certain information, they still have to do it, even if this article does not specifically mention it. These discovery rules work alongside constitutional rights, not instead of them.
