§ 212.31 Restoration after jury disagreement, mistrial or order for new trial

Sometimes a jury can't agree on a verdict, a judge declares a mistrial, or a new trial gets ordered by a judge or a higher court. When any of these things happen, the case isn't over. It needs to go back on the court's schedule so it can be tried again.

This rule explains how that happens. Someone has to file a notice with the court clerk saying the case is ready to be tried again. Once that notice is filed, the case goes back onto the "ready calendar," which is the list of cases waiting for a new trial date.

For people involved in a lawsuit, this means the case doesn't just sit in limbo after a failed trial. Filing the right paperwork gets the process moving again so a new trial can be scheduled.
