§ 1122 Delivery of estate assets to fiduciary; expenses, costs and commissions

When someone else takes over an estate from the public administrator, the public administrator has to hand over everything they were holding for that estate. This means all the money and property that belongs to the estate must go to the new person in charge, called the fiduciary.

Before handing everything over, the public administrator gets to keep back money to cover their own expenses and costs. They also get to keep their commission, which is the fee they earn by law for handling the estate. Once those amounts are subtracted, the rest of the property and assets go to the new fiduciary who is taking over the case.

This rule makes sure there is a clean handoff when a public administrator's job on a case ends. It protects the public administrator's right to be paid for the work they already did, while also making sure the estate's property moves smoothly to whoever is taking over next.
