§ 1302 Kinds of property

This rule explains what kind of property can be handled under this article of the law. It does not cover real estate (like land or buildings) that a person owned in New York State when they died. If someone dies owning property like that, this article's rules do not apply to it.

However, owning real estate does not stop this article from being used for the rest of the person's belongings. So if someone dies owning a house plus things like bank accounts, cars, or personal items, this article can still be used to handle those other belongings, even though it won't cover the house itself.
