§ 2608 Expenses of surrogate or clerk

If you ask a surrogate's court judge or clerk to travel somewhere outside the courthouse to take testimony, you have to pay for their trip. This might happen if a witness can't come to court, for example if they're sick or unable to travel, and the judge or clerk needs to go to them instead.

The rule says you only have to cover their actual and necessary costs. This means real expenses like transportation, not made-up or padded charges. If you're the one requesting this special arrangement, be ready to cover these costs out of pocket.
