§ 310 Who may serve process 1

Anyone who is at least 18 years old can deliver court papers (called "process") to the people involved in a Surrogate's Court case. This is true even if that person is also part of the case themselves. For example, one of the parties in the case could personally hand-deliver the papers, as long as they are 18 or older.

If the papers need to be delivered to someone outside New York State, the same rule applies. The person delivering the papers can still be involved in the case, and they follow the same delivery methods allowed under New York's general civil procedure law (CPLR 313).
