§ 810 Application of article to fiduciaries heretofore appointed

This rule says that the rules in this article apply to fiduciaries who were already appointed before the law took effect. It also applies to trusts that were already set up before the law took effect. In other words, the new rules are not just for future cases. They also cover people already serving as executors, trustees, guardians, or other fiduciaries when this law came into force.

There is one important exception. The rule does not change the responsibility of sureties on bonds that were already signed before this law took effect. A surety is a person or company that guarantees a fiduciary will do their job properly, often by backing a bond with money. If that bond was already in place before the new rules started, the surety's obligations stay the same as they were under the old rules. The new law does not add to or take away from what that surety already agreed to.
