§ 207.36 Failure to file timely objections

If you miss the deadline to file objections in a Surrogate's Court case, the court will not accept your objections after that point. There are only two ways around this. Either every party in the case agrees in writing to give you more time, or a judge specifically orders that your late objections can be filed anyway.

This means you cannot simply hand in objections late and expect the court to accept them. You need to act before your deadline passes. If you know you are going to miss it, you should reach out to the other parties right away to see if they will agree to an extension, or ask the court for permission before time runs out. Waiting until after the deadline has already passed makes things much harder, since you will need to convince a judge to make an exception for you.
