Rule 37 Interest on Judgment

If you win a money judgment in a civil case and the other side appeals, this rule explains what happens with interest while the appeal is going on.

If the appeals court agrees with the lower court's decision and keeps the judgment in place, interest still counts. It starts from the date the original judgment was entered in district court, not from the date the appeals court makes its decision. This means the person who owes money doesn't get a break on interest just because they appealed.

If the appeals court changes the judgment or reverses it and sends the case back for a new money judgment, the appeals court can give specific instructions about how interest should be handled. This gives the court flexibility to decide what's fair based on what happened in that particular case.
