The forms contained in the appendix of forms are illustrative and not mandatory.

This rule deals with the forms found in the appendix of the North Dakota Rules of Criminal Procedure. It simply says that these forms are examples you can look at, not forms you are required to use.

If you are involved in a criminal case, you do not have to copy these forms word for word or use the exact format shown. They are there to give you an idea of what a document might look like, but courts, lawyers, and other people involved in a case have flexibility in how they prepare their own paperwork. As long as your documents meet the actual legal requirements, you do not need to match the sample forms exactly.

Rule 58 was amended, effective March 1, 2006.

Rule 58 is similar to N.D.R.Civ.P. 84. The forms are found in the appendix of forms. The practice of appending illustrative forms to serve as guides has been found useful in connection with many criminal codes.

Rule 58 was amended, effective March 1, 2006, in response to the December 1, 2002, revision of the Federal Rules of Criminal Procedure. The language and organization of the rule were changed to make the rule more easily understood and to make style and terminology consistent throughout the rules.
