Rule 505 Trade Secret Privilege

If you own a trade secret, like a special formula, process, or business method, you have the right to keep it private during a court case. This means you can refuse to share it, and you can also stop others (like an employee or business partner) from sharing it in court. This right belongs to you, but your agent or employee can also speak up and claim this protection on your behalf.

This privilege isn't absolute. A judge can still order you to disclose the trade secret if keeping it hidden would help someone commit fraud or create an unfair result in the case. In other words, you can't use "trade secret" as an excuse to cover up wrongdoing.

If a judge does order you to reveal the trade secret, the court has to take steps to protect it as much as possible. This might mean limiting who can see the information, sealing certain documents, or setting other rules to keep the secret from spreading further than necessary. The goal is to balance your business interests with the needs of the court case and fairness to everyone involved.
