(a) Continuity of Representation on Appeal.
(1) Counsel in criminal cases, whether retained or appointed by the Superior Court, shall ascertain whether the defendant wishes to appeal and file a notice of appeal upon the defendant’s request. Counsel shall continue to represent the defendant on appeal until counsel is relieved upon filing a motion for substitution of counsel and replaced by substitute counsel or by the defendant pro se.
(2) If counsel’s appointment continues on appeal in accordance with this rule, counsel shall provide notice to the Clerk that he or she is representing the client by virtue of a court appointment.
