Rule 14 Computing, Extending, and Reducing Time

Title III: General Provisions

(A) Computing time In computing any time period prescribed or allowed by these rules, by any local rule or court order, or by any applicable statute that does not specify a method of computing time, exclude the day of the event that triggers the period. Except as indicated in the last sentence of this paragraph, count every day, including intermediate Saturdays, Sundays, and legal holidays. Include the last day of the period, unless it is a Saturday, Sunday, or a legal holiday, in which case the period runs until the end of the next day that is not a Saturday, Sunday, or legal holiday. When the time period prescribed or allowed is less than seven days, exclude intermediate Saturdays, Sundays, and legal holidays.

(B) Extending or reducing time For good cause, the court, upon motion, may extend or reduce the time prescribed by these rules or by its order for doing any act, or may permit an act to be done after that time expires. The court may not extend or reduce the time for filing a notice of appeal under App.R. 4 or a motion to certify under App.R. 25.

(C) Additional time after service by mail or commercial carrier service When a party may or must act within a specified time after being served, and the paper— whether it is sent by the clerk or by a party to the case—is served on the party by mail or commercial carrier service under App.R. 13(D)(4), three days are added to the specified period. When, however, the court has ordered a party to act by a particular date, that party must comply with the court’s order and is not entitled to an additional three days.

This division does not apply to responses to service of summons in original actions.
