Rule 40 Pre-Recorded Testimony

In Ohio courts, witnesses do not always have to appear in person at trial. Their testimony can be recorded on video ahead of time and then played for the judge or jury during the trial.

This option must follow the Ohio Rules of Superintendence, which are separate rules that govern how courts run their day-to-day operations. Those rules set the specific requirements for how video recordings must be made and used.
