Sec 5.9 Proceedings Which Are to be a Matter of Public Record

Once a formal disciplinary case moves forward under Rules 6, 7, 8, or 11, it becomes part of the public record. This means the case gets filed with the Clerk of the Supreme Court, and anyone can access information about it.

There is one exception to this rule. If Rule 5.7 limits what can be shared, that limit still applies even after the case becomes public. So while most details will be open for anyone to see, some specific information might still be protected under that separate rule.

This matters because it affects privacy during a disciplinary case. Once the process reaches these stages, the person involved should expect that the case details are no longer private and can be viewed by the public.
