Sec 8.2 Order Approving; Reinstatement

When a lawyer wants to resign while facing disciplinary charges, they have to submit a sworn affidavit. Once the Commission gets this affidavit, it files it with the Clerk of the Supreme Court. The Supreme Court can then issue an order officially accepting the resignation.

If a lawyer resigns this way, they can't just come back to practicing law whenever they want. They have to wait at least five years before asking to be reinstated. Even after waiting five years, they still have to follow the specific reinstatement process laid out in Rule 11 to get their law license back.
