§ 1144 Action by tenant against cotenant.

If you own property jointly with someone else (like a sibling or business partner) and you need to sue them over that property, you have to prove more than just your ownership rights. You must also show that they actually did something to challenge or deny your rights to the property.

This means your court filing needs to include specific facts. You have to say either that your cotenant flat out refused to recognize your ownership, or that they did something that clearly showed they were denying your rights, like blocking your access to the property or treating it as solely theirs.

This rule exists because co owners normally share rights to the same property without conflict. Courts need proof that an actual dispute exists before they will step in. Simply owning property together is not enough grounds for a lawsuit. Something has to have gone wrong first, and you need to spell out what that something was when you file your case.
