§ 1584 Improper issue of order of delivery.

If a court clerk issues an order to take property from someone, but the required affidavit and bond were never properly filed first, that order is invalid. The court will cancel the order, and the clerk who issued it without these documents has to pay the costs involved.

On top of that, the person who asked for the order (the plaintiff) can also be held responsible. If their improper order caused harm to the other party, that person can sue for damages. This rule exists to protect people from having their property taken away without the proper legal steps being followed first.
