Every mediation program set up under the Choice in Mediation Act has to give people a way to complain. If you're part of a dispute and you have a problem with how the mediation went or how the mediator acted, the program must have a process for you to speak up about it. The person running the program can also raise concerns about a mediator.

If a complaint could lead to a mediator being removed from the approved list or losing their certification, the mediator can't just be kicked out without a fair process first. They're entitled to due process, meaning they get a chance to know what they're accused of and respond to it before any final decision is made. This protects mediators from being removed unfairly based on one-sided complaints, while still giving people a real way to report problems when something goes wrong.
