§ 2305 Inconsistent presumptions.

Sometimes two legal assumptions (called presumptions) point in opposite directions in the same case. When this happens, the judge has to decide which one makes more sense based on sound reasoning and fairness. The judge will pick the presumption that is backed by the stronger, more sensible policy reasons.

But sometimes neither presumption is clearly stronger than the other. If the judge can't tell which one deserves more weight, then both presumptions get thrown out. The case moves forward without either one being applied, and the facts have to be decided based on the actual evidence presented instead.
