§ 3226A Withdrawal of certain discovery items.

If you filed discovery materials with the court, like depositions or written answers to questions, you may need to take them back once the case is over. This rule sets a window of time for doing that.

If no one appeals the case, you must pick up these documents no earlier than 30 days and no later than 60 days after the judgment or final order is filed. If the case was appealed, you have 30 days after the appeals court sends back its final decision (called a mandate) to pick them up.

This only applies to discovery items that were never actually used as evidence in the case. It also does not apply to anything that was made part of the appeal record or that the court still needs if the case is sent back for more work. You will need to sign a receipt with the court clerk when you pick up the documents.

This rule helps keep court files from getting cluttered with paperwork that is no longer needed. It also puts the responsibility on the parties, not the court, to store these documents once the case wraps up.
