§ 3316 Confidentiality of collaborative law communication.

When parties use collaborative law to try to resolve a dispute (usually in family law cases), what they say during the process can be kept private. This privacy is not automatic just because the law exists. Instead, the parties themselves decide how much confidentiality they want, and they need to put that agreement in writing and sign it.

If the parties don't spell out their own confidentiality terms, other Oklahoma laws outside of this collaborative law act might still apply and offer some protection. But the main point is that privacy in these discussions depends on what the people involved agree to in writing, not on some blanket rule that automatically seals everything said during the process.

This matters because collaborative law only works if people feel safe being honest and open. Knowing upfront what will and won't stay private helps everyone decide how freely to talk during settlement discussions.
