§ 3322 Relation to Electronic Signatures in Global and National Commerce Act.

This law works alongside a federal law called the Electronic Signatures in Global and National Commerce Act. That federal law sets basic rules for using electronic signatures and records in business and legal matters across the country. Oklahoma's law changes and takes the place of most parts of that federal law within the state.

Oklahoma's law cannot change the part of the federal law that requires businesses to get clear consent from consumers before sending them electronic records instead of paper ones. It also cannot allow certain important notices to be delivered electronically. These protected notices include things like court orders, eviction notices, notices about canceling health or life insurance, product recalls that affect safety, and documents required for handling hazardous materials.

In simple terms, this rule means Oklahoma has its own version of e-signature rules, but it still has to follow certain federal protections. These protections make sure people give real consent before switching to electronic records, and they make sure certain critical notices still get delivered in a way that reaches people reliably, not just through email or digital files.
