§ 398 Examination by deposition - Custody.

If a prisoner needs to give a deposition (testimony taken outside of court, usually recorded by a court reporter), the prisoner stays in custody the whole time. The person in charge of guarding the prisoner, like a jail or prison official, doesn't hand over control to anyone else just because a deposition is happening.

That same official also has to make it possible for the deposition to actually take place. This means giving reasonable access, space, and cooperation so the prisoner can answer questions and the deposition can move forward smoothly. The goal is to balance security needs with the legal right of both sides to gather testimony in a case.
