Here's what this rule means. If a case involves a legal question, meaning a dispute about how the law should be applied or interpreted, a judge decides it. These are called "issues of law," and they don't go to a jury unless the case has been sent to a referee for review.

If the case involves a factual question, like whether someone owes money or who rightfully owns a piece of property, a jury normally decides that question. This applies to lawsuits asking for money damages or asking the court to award specific property, whether it's real estate or personal belongings.

However, a jury trial isn't automatic in every situation. The people involved in the case can agree to skip the jury and let a judge decide the facts instead. A jury trial can also be avoided if the court sends the factual questions to a referee to review and report back, instead of using a jury.
