§ 709 Effect of violation.

If a judge issues an order or judgment without proof that the required notice was given, that order or judgment doesn't count. It's treated as if it never legally happened.

The court doesn't need someone to file a complaint or ask for a hearing to fix this. Once the judge realizes proper notice wasn't given and proven, the judge must cancel the order or judgment on their own, without anyone having to request it.

This rule protects people's right to know about legal actions that affect them. If you were never properly notified about a case, any decision made against you can be thrown out once that lack of notice comes to light.
