Rule 10.3 Notice

If you want to ask the Oklahoma Court of Criminal Appeals for extraordinary relief, you have to let the other side know about it first. The court will not hear your request unless you can show that the other party was properly notified.

This means your petition and the supporting brief must include proof that you sent copies to the other side. You cannot simply file your request with the court and hope it gets heard. You need to document that the adverse party received notice, or the court will not consider your case.

This rule exists to keep things fair. Both sides deserve a chance to know what is happening in a case and respond to it. Skipping notice would let one side make a request behind the other's back, which the court will not allow.
