§ 1056 Appeal by state not to suspend judgment.

If the state decides to appeal a case, the defendant still benefits from the judgment while that appeal is going on. In other words, the case result stays in effect and helps the defendant right away. The state's appeal does not pause or cancel this benefit.

The judgment only changes if a higher court actually reverses it. Until that happens, the defendant keeps whatever the court decided in their favor. This means someone cannot be held back or punished based on a judgment that hasn't actually been overturned yet, even if the state is fighting the decision in court.
